6. Health Information
Liro Pilates is not a healthcare provider, and this Site and our Studio are not "covered entities" under the Health Insurance Portability and Accountability Act (HIPAA). 1. Acceptance of Terms
These Terms of Use ("Terms") govern your access to and use of the website LIROPILATES.com (the "Site") and the Pilates classes, private instruction, workshops, and membership services offered by Liro Pilates, LLC. ("Liro Pilates", "we", "us", or "our") in Anchorage, Alaska. By accessing the Site, booking a class, or purchasing a membership, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Site or our services.2. Eligibility
You must be at least 18 years old to create an account, book classes, or purchase a membership on your own behalf. Participants under 18 may attend classes only with the consent, registration, and supervision of a parent or legal guardian, who agrees to be bound by these Terms on the minor's behalf.3. Booking, Memberships, and Payment
3.1 Bookings and payments for classes, private sessions, workshops, and memberships are processed through our third-party booking platform, Walla. By booking, you agree to Walla's applicable terms in addition to these Terms.3.2 Membership plans, punch cards, and package pricing are as described on the Site at the time of purchase and are subject to change. Certain memberships require a minimum commitment period (for example, a three-month minimum), as described on the Site.3.3 You are responsible for providing accurate billing and contact information and for any charges incurred under your account, including recurring membership charges until you properly cancel in accordance with our cancellation procedures.3.4 Except as required by law or as otherwise stated at the time of purchase, fees for classes, packages, and memberships are non-refundable.4. Cancellation, Late Arrival, and No-Show Policy
Class reservations may be canceled without penalty up to 12 hours before the scheduled class. Cancellations made within 12 hours of class are subject to a $15 late cancellation fee or forfeiture of a class credit. No-shows are subject to a $20 fee. Private sessions require at least 24 hours notice to cancel or reschedule.Members receive one complimentary late cancellation per month (up to four annually). We recommend arriving at least 10 minutes before class; clients arriving after class has begun may not be admitted. These policies, along with our studio etiquette guidelines (for example, grip socks, a scent-limited environment, and phone/device etiquette), are set out in more detail on our Policies & Guidelines page, which is incorporated into these Terms. We may update these policies from time to time.5. Assumption of Risk; Health and Fitness Disclaimer
5.1 Pilates and other physical exercise involve inherent risks of injury. By participating in classes, private sessions, or workshops, you acknowledge and voluntarily assume all risks associated with physical activity, including but not limited to muscle strains, sprains, and other injuries.5.2 Liro Pilates instructors are not acting as medical professionals providing medical advice (even where an instructor holds outside healthcare credentials), and nothing in a class, on the Site, or in any communication from us is intended as medical advice. You should consult your physician before beginning this or any exercise program, particularly if you are pregnant, postpartum, recovering from injury or surgery, or have a pre-existing medical condition.5.3 You are responsible for informing your instructor of any injuries, medical conditions, or physical limitations before class, and for using your own judgment about modifying or discontinuing any exercise that causes pain or discomfort.5.4 Clients may be required to sign a separate liability waiver and informed consent form in person or electronically before participating in classes. These Terms do not replace that waiver; both apply to your relationship with us.6. Studio Conduct
We want Liro Pilates to be a safe, respectful, and welcoming space for all clients and staff. We reserve the right to refuse service to, and to suspend or terminate the membership or Studio access of any individual who engages in unsafe, disruptive, harassing, or disrespectful behavior toward other clients, staff, or Studio property, in our reasonable discretion.7. Intellectual Property
All content on the Site, including text, graphics, logos, images, class descriptions, and the Liro Pilates name and branding, is owned by or licensed to Liro Pilates and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any content on the Site without our prior written consent, except for personal, non-commercial use.8. Acceptable Use of the Site
You agree not to: (a) use the Site for any unlawful purpose; (b) attempt to gain unauthorized access to the Site, our systems, or other users' accounts; (c) interfere with or disrupt the operation of the Site; (d) upload or transmit viruses or other harmful code; or (e) scrape, harvest, or collect information about other users without their consent.9. Third-Party Services and Links
The Site may link to or integrate with third-party services, including Walla (booking and payments) and Instagram and Facebook (social media). TO THE FULLEST EXTENT PERMITTED BY LAW, LIRO PILATES, LLC AND ITS OWNERS, INSTRUCTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PARTICIPATION IN CLASSES OR STUDIO SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, EXCEPT TO THE EXTENT SUCH LIABILITY CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW. THIS LIMITATION IS IN ADDITION TO, AND DOES NOT REPLACE, ANY SEPARATE LIABILITY WAIVER YOU SIGN WITH US.12. Indemnification
You agree to indemnify and hold harmless Liro Pilates, LLC and its owners, instructors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising out of your violation of these Terms or your use of the Site or Studio services.13. Governing Law and Disputes
These Terms are governed by the laws of the State of Alaska, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or our services shall be brought exclusively in the state or federal courts located in Anchorage, Alaska, and you consent to the personal jurisdiction of those courts.14. Changes to These Terms
We may revise these Terms from time to time. The "Last Updated" date above reflects the most recent revision. Your continued use of the Site or our services after changes take effect constitutes your acceptance of the revised Terms.15. Severability
